Introduction

This Service is operated from Switzerland by an independent developer. Throughout these Terms, "we", "us", or "our" refers to the operator of the Service.

These Terms apply from the moment you access or use the Service in any way. By using Ari — Gentle Support Companion ("the Service"), you agree to be bound by these Terms & Conditions.

The Privacy Policy is incorporated into these Terms by reference and forms part of your agreement with us.

User Consent & Account Creation

By creating an account, you provide explicit consent for us to:

✓Collect and process your username, email (encrypted), and password (hashed) to provide the service

✓Track your session usage and entitlements to manage your account

✓Store payment references (via Stripe) to link purchases to your account

✓Send service-related communications (e.g., account verification, password resets)

During signup, you confirm that you are at least 18 years old and agree to these Terms and our Privacy Policy. You can withdraw consent and delete your account at any time.

Service Description

✓Free Trial: New users receive a 5-minute free trial to experience the service

✓Session Bundles: After the trial, continued access requires purchasing a session bundle (one-time payment, valid for 90 days)

✓AI-Powered Support: The service uses artificial intelligence to provide emotional support and guidance

✓Account Access: Using the companion requires creating an account and signing in

✓Session Management: Sessions are managed through secure server-side tracking using HTTPOnly cookies and authenticated tokens

Payment Terms & Pricing

✓Single Session: A one-time payment for a single 30-minute session, must be used within 30 days

✓Session Bundle: A one-time payment grants pooled allowance of session time (e.g., 7 × 30-min sessions), use flexibly with no per-session limits

✓Bundle Validity: Session bundles expire after 90 days, single sessions after 30 days. Unused time is non-refundable

✓Payment Processing: All payments securely processed through Stripe, Inc.

✓No Refunds: All sales are final. Sessions begin immediately upon purchase

Payment methods may be optionally saved with Stripe for future convenience. Sessions are managed through secure HTTPOnly cookies.

Privacy & Data Handling

✓Account Requirement: Access requires an authenticated account. We collect only data needed to operate the service

✓Conversations: All conversations are processed in real-time and not stored after your session ends

✓AI Training: Your conversations are not used to train OpenAI's models and are only retained temporarily (up to 30 days) for abuse monitoring

✓Secure Sessions: Managed using HTTPOnly cookies and signed tokens protecting against XSS attacks

✓Account Retention: Accounts inactive for 365+ days may be deleted along with associated tokens

Account Management

✓Keep your username and password confidential — do not share credentials

✓We maintain reasonable safeguards to protect account data

✓Accounts with no sign-in activity for 365+ days are subject to deletion

✓You can delete your account at any time from account settings

Medical Disclaimer

Ari is NOT a therapist, counselor, psychologist, psychiatrist, or healthcare provider. The service does not provide therapy, medical care, clinical treatment, diagnosis, or patient care of any kind.

✓Reflective Coaching Tool: AI-powered reflective coaching, emotional support, and general guidance only

✓Not a Substitute for Professional Care: Not intended to treat, diagnose, or manage any medical or mental health condition

✓No Clinical Relationship: Using the service does not establish a professional medical or therapeutic relationship

✓Crisis Situations: If experiencing a mental health crisis, contact local emergency services or a crisis hotline immediately

Acceptable Use

Use the service only for its intended purpose of reflective coaching, emotional support, and personal guidance.

Prohibited activities include:

✓Illegal activities or purposes violating applicable laws

✓Harassment, abuse, threats, or harm to yourself or others

✓Fraudulent, deceptive, or unethical purposes

✓Attempting to obtain medical advice, diagnosis, or treatment

✓Exploiting, manipulating, or circumventing the AI system

✓Sharing session tokens, accounts, or bypassing authentication

Service Availability

✓Best Effort: We strive for consistent availability but cannot guarantee 100% uptime

✓Maintenance: May be temporarily unavailable for maintenance

✓Session Limits: Bundles provide pooled time within 90 days of purchase

✓Technical Requirements: You are responsible for compatible devices and connectivity

Intellectual Property & AI License

You are granted a limited, non-transferable, non-exclusive license to use the Service for personal, non-commercial purposes.

✓Service Ownership: All software, content, and technology is our proprietary property

✓Limited License: Non-exclusive license for personal use only

✓Conversation Ownership: You retain ownership and responsibility of your input during sessions

✓No Reverse Engineering: You may not copy, extract, modify, or redistribute any part of the Service

Limitation of Liability

✓No Warranties: The service is provided "as is" without warranties of any kind

✓Limited Liability: Our liability is limited to the amount paid in the past 30 days

✓Exclusion of Damages: We are not liable for indirect, consequential, emotional, psychological, or mental health damages

✓User Responsibility: You use the service at your own risk and discretion

✓Third-Party Services: We are not responsible for issues with Stripe, OpenAI, or other providers

Termination

✓User Termination: You may stop using the service at any time

✓Service Termination: We reserve the right to terminate access for violations

✓Effect: Upon termination, access ends immediately with no refund of unused sessions

AI Limitations

▾

Ari is an artificial intelligence and does not possess human understanding, empathy, or awareness, even though it may sound humanlike.

✓AI may generate inaccurate, inappropriate, or completely false information ("hallucinations")

✓Responses are not fact-checked and may contain harmful advice despite safety measures

✓The AI cannot accurately assess your actual mental or emotional state

✓Responses are generated based on patterns and probabilities

Governing Law & Disputes

These Terms are governed by the laws of Switzerland. Any dispute shall be resolved through individual arbitration or mediation under Swiss law, exclusively in Swiss courts.

You agree to indemnify and hold harmless the creators and operators of the Service from any claims resulting from your use of the Service or violation of these Terms.
